The Miccosukee Land Co-op Tractor Use Agreement
August 2020

By signing below, I hereby agree that I am over the age of 18, that I am responsible, that I understand and will abide by all the rules and guidelines set out in The MLC Tractor Use Policy and The MLC Tractor Operator Manual and to the conditions below.

I fully intend and choose to give up the legal rights, as stated below:

1. TO WAIVE ANY AND ALL CLAIMS that I have or may have in the future against the Miccosukee Land Co-op directors, officers, or members relating to the use of the MLC tractor.

2. TO RELEASE the Miccosukee Land Co-op from any and all liability for any loss, damage, injury, expense, or other cost that I may suffer or that my next of kin may suffer in connection with use of the MLC tractor to any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF MLC.

3. TO HOLD HARMLESS AND INDEMNIFY the MLC from any and all liability to property, or personal injury to, any third party, resulting from the use of the MLC tractor.

Furthermore, I agree to the following:

1. That I will immediately report any system failures, damage to the tractor or implements, or operational problems to the Maintenance Supervisor.
2. That I will pay for any damage to the tractor or tractor implements that is incurred while using the tractor for private work.
3. That I will operate the tractor in a safe manner and treat the tractor appropriately; for example: I won’t pull stumps, use the tractor while under the influence of substances, beat on the tractor or tractor implements with hammers, lift people into the air, speed when leaving barn or at any time, carry passengers, or stress the tractor with any kind of work that raises the back wheels.
4. That I will log all tractor operation clearly and completely, clean the tractor and implements after every use, keep the fuel tank at 3/4 full, and leave the tractor barn tidy.
5. That I will pay MLC for all private work immediately upon completion of that work.
